Expiation options

If you have received an expiation notice your options are to:

  • pay the expiation
  • nominate another driver
  • nominate the new owner
  • request a review
  • elect to be prosecuted in Court
  • apply for permission to pay fees in instalments
  • no action.

Pay the expiation

Expiation fees must be paid in full by the due date on the notice:

  • in person at City of West Torrens, 165 Sir Donald Bradman Drive, Hilton
  • online
  • by mail to City of West Torrens, 165 Sir Donald Bradman Drive, Hilton
  • by phone (08) 8416 6333.

Paying the fine does not mean you are admitting liability for what caused the offence and a conviction will not be recorded.

Nominate another driver

If you were not driving the vehicle at the time of the offence you can nominate another driver.

Complete the Expiation nomination form and submit before the notice is due.

Do not pay the expiation. A notice will be issued to the nominated driver once we received the Expiation nomination form. 

Nominate a new owner

If you were not the owner of the vehicle at the time of the offence you can provide the details for the new owner.

Complete the Expiation nomination form and submit before the notice is due.

Review expiation evidence/photos

Please note that photos are only available to view online for 90 days from the date of offence. If your photos do not display or are not available, please do not hesitate to contact our Community Safety Team for assistance.

Request for a review of a parking expiation

The City of West Torrens reviews expiations based on the Council Expiation Review Policy.

(This Policy is available on line or by contacting 8416 6333 and requesting a copy to be sent to you.)

For your convenience and easy reference, we have compiled the Expiation Review Information Guidelines.

The Policy allows for consideration of a review on specific grounds. The grounds for consideration of an expiation are as follows:

  • If you did not commit the offence(s).
  • If there was a processing error, including an oversight of the facts or a procedural error has occurred rendering the expiation notice defective.
  • That the expiation notice should not have been issued with respect to the offence(s).
  • If it is decided that the alleged offender should be prosecuted for the offence(s).
  • If a reviewing officer is satisfied that the offence is "trifling". (Refer to "Expiation Review Information Guidelines" for explanation of trifling grounds).

As per Council's Policy only one review will be considered and the Council's determination is final. However, if you are unhappy with the outcome of the review, you may elect to be prosecuted.

Nothing in the Policy prevents you from making a complaint to the Ombudsman at any time under the Ombudsman Act 1972.

In most cases reviews are only accepted from the expiated person to their legal representatives. If the expiated person authorises someone else to make the application on their behalf, the outcome of the review will be sent to the expiated person, not the person authorised to make the application.

Elect to be prosecuted for the offence in court

If you choose to be prosecuted you must complete and submit the section on the end of the notice.

When you have chosen this option for the alleged offence, a summons will be issued to attend court at a nominated date and time.

If you are found guilty, the Court may require you to pay not only a court fine as a penalty, but also prosecution and court costs and levies. A conviction may also be recorded.

Once you have chosen this option, you cannot change your mind and seek to be expiated.

Apply for permission to pay the fee in instalments

You may make an application to enter into a payment arrangement with the Fines Enforcement and Recovery Unit which may include a payment of the amount of the fee(s) in instalments or other options by agreement with the Fines Enforcement and Recovery Officer. A fee will apply to enter into an arrangement. The Fines Enforcement and Recovery Officer can be contacted on 1800 659 538 or at www.fines.sa.gov.au.

It should be noted that for amounts of less than $100, the Fines Enforcement and Recovery Unit will only enter into payment arrangements in cases of demonstrable and verifiable hardship.

No action

If no choice is made for an offence, one reminder notice will be sent (a reminder notice fee plus costs will apply). After that the matter may be referred to the Fines Enforcement and Recovery Unit which may take enforcement action against you. This may involve entering into a payment arrangement or property that you own (including motor vehicles and land) being seized and sold. An additional amount will become payable if enforcement action is taken.
