If you know something about a serious wrong doing by an employee or an elected member of the Council it can be reported in confidence under the Whistleblowers Protection Act 1993.

 

About the Whistleblowers Protection Act 1993

The purpose of the Whistleblower Protection Act 1993 is to provide a means for:

  • disclosure of information in the public interest of a serious wrongdoing
  • protection for those making a disclosure.

 

About serious wrongdoing

Serious wrongdoing is a term which includes:

  • illegal activity
  • irregular and unauthorised use of public money
  • mismanagement of public resources
  • conduct that causes substantial risk to public health or safety
  • conduct that causes substantial risk to the environment
  • maladministration in the performance of official functions.

If proven, such conduct could be a criminal offence or grounds for dismissal.

 

Who can report a serious wrong doing

A serious wrong doing can be reported by:

  • any member of the public
  • elected members
  • council employees.

 

Protection for whistleblowers

The Act provides civil and criminal protection and immunity for anyone who makes an appropriate disclosure of public interest information. It protects against victimisation or any other detrimental action such as harassment, intimidation, discrimination or adverse treatment.

If you make a false disclosure it could lead to an $8,000 fine or two years imprisonment.

 

How to report wrong doing

To make a report contact the Responsible Officer appointed to receive and act upon information reported by whistleblowers. At City of West Torrens the Responsible Officer is the General Manager Business and Community Services.
